Terms of Service

These Terms of Service (“Terms”) govern your use of xInsightss, a web application available at xinsightss.eu, and any related services provided by Michał Florczak (NIP 5521733765) (“we”, “us” or “our”). By signing in or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Description of Service
xInsightss keeps a saved copy of the posts and public metrics of the X account you sign in with, builds analytics from that copy, checks on its own schedule for new comments under your posts and for posts that mention you so you can answer them, tracks your followers and who unfollows you, tracks an impressions goal, and can share your saved data with an AI assistant through the Model Context Protocol (MCP). You can follow and unfollow accounts from the app, and on Pro and Power switch on automatic follow-back and automatic unfollow, which then act on your X account without a click until you switch them off. Replies and posts can carry images you attach, which are uploaded to X when you send.
If you separately opt in, the Service can also send eligible saved comments and their context to TypeSafe AI in the United States for fixed beta classifications, to score whether a comment is worth a reply and whether its author looks like a bot, and to sort comments and mentions into important ones and simple reactions. The AI reply button can request an editable suggestion from OpenAI using saved conversation context and, when you ask for a rewrite, your draft; the other AI features described in the Privacy Policy run only when you use them. Studio keeps a viral library of public posts by other X accounts that clearly outperformed their audience, gathered from Patterns, your role models, your trend searches and one automatic search a day in your niche. In Studio, each message you send goes with your session notes and short excerpts of your own saved posts and of posts from your viral library to TypeSafe AI, which picks the relevant ones, and the chosen posts, the conversation and the inspirations you attached go to OpenAI, which writes the answer or the drafts you ask for. Viral posts serve only as inspiration for structure, hook and format.
The Service publishes on X only the replies and posts you send yourself, the Reply Assistant drafts you approve, and, where we have enabled it for your account, the automatic replies of Reply Assistant (see Reply Assistant below). If you switch on Always improve with AI, the AI-improved version of your reply is published when you press Improve & reply, without another review. Follows and unfollows happen only when you click them or after you switch on the automation. Replies and direct messages you put in the Queue are not sent by the Service: the optional xInsightss Chrome extension opens each one on x.com in your own browser with your text filled in, and you post or send it yourself.
2. Eligibility and account
You must be at least 18 years old and entitled to use the X account you sign in with. The Service works only with that account. You are responsible for keeping your X credentials and any MCP token you create confidential, and for all activity that occurs under your account. You can revoke our access to your X account at any time in your X settings.
3. Use of the Service
You agree to use the Service in compliance with all applicable laws and with X's terms and rules. You must not:
- Use the Service to send spam, harass anyone, or automate engagement in a way X prohibits.
- Interfere with or disrupt the Service, or attempt to access other users' data.
- Reverse engineer the Service or resell access to it.
Every reply published through the Service, including every reply Reply Assistant publishes after you switched it on, and every reply or direct message you send from the Queue, is published on your behalf and under your X account; you are solely responsible for its content.
4. Reply Assistant
Reply Assistant is off until you switch it on, separately for comments under your posts and for posts that mention you, and confirm that you agree to these terms for it. While it is on, the Service sorts new comments and mentions with TypeSafe AI and writes a short reply in your style with OpenAI to those it classifies as simple reactions (such as congratulations, thanks, praise or an emoji) and, if you also switch on Answers to your questions or Opinions about your posts, to comments that answer a question you asked in your post or that agree, share an experience or joke about it, with a short closing remark that takes no side your post does not take. It never answers comments it classifies as questions or as important, it answers only comments made directly under your post (never a reply to one of your replies), and at most one AI reply is written for each comment or mention and for each person in a conversation.
By default Reply Assistant only prepares drafts: nothing is published until you review the drafts, edit or skip any of them, and approve the ones you want. The approved replies are then published from your X account in the background, one every few seconds, as long as the comment still exists unchanged and unanswered. You can stop a batch at any time; replies not yet being sent then return to your drafts. Drafts expire when the comment is answered, edited or removed, or after 48 hours.
On accounts where we have enabled it on request, you can instead let Reply Assistant publish its replies without asking you first. A reply whose publication is uncertain is never sent again automatically in either mode.
Questions groups the questions people ask you in comments and mentions. When you answer a group once, Reply Assistant writes a reply to each person who asked, in their language, using only what you wrote; these replies follow the same approval, sending and limits as other Reply Assistant replies. Complaints and bug reports are not grouped and stay in your inbox.
You can add links to your own products in Reply Assistant settings. When you add a link, OpenAI's web search reads that page and fills in the product's name and a one-sentence description, which you can change; at most 20 pages are read in any 24 hours. Product names, descriptions and links are sent to OpenAI when Questions are sorted and replies are written. When people ask where to find or how to get one of your products, Reply Assistant may answer them with its name and link. A reply that carries a link always waits for your approval, even on accounts where automatic sending is enabled. Add only links you are allowed to share; you are responsible for them like for anything else you publish.
If you switch on Ask to connect, a reply to someone who does not follow you, as far as the Service knows, ends with a short invitation to connect in your words. It never asks them to follow you and never promotes anything.
Each published reply uses actions exactly like a reply you send yourself. Reply Assistant writes at most 20 replies on Creator, 100 on Pro and 300 on Power in any 24 hours, across all your X profiles, and it stops publishing when your actions run out. You can switch it off at any time; it then writes and publishes nothing more, except a reply already being sent at that moment.
AI classification and writing can be wrong: a comment may be misread, or a reply may be inaccurate, unsuitable or similar to an earlier one. X's rules restrict automated and AI-written replies, and X may limit, hide, label or suspend accounts or applications that use them. You switch Reply Assistant on at your own risk, you remain responsible for every reply it publishes, approved or automatic, as if you had written it, and you must use Reply Assistant only in a way X permits. To the maximum extent permitted by law, we are not liable for the content of Reply Assistant replies or for any action X takes against your account because of them. Nothing in this section limits liability that cannot be limited by law or your statutory consumer rights.
5. Plans, action allowances and payments
The Service is sold as a monthly or annual subscription: Creator ($19/month or $190/year), Pro ($49/month or $490/year), or Power ($99/month or $990/year). Annual pricing gives two months free. Prices are in US dollars and exclude applicable taxes, which are calculated at checkout.
Each plan has a monthly action allowance: 300 for Creator, 1,200 for Pro, and 3,000 for Power. Annual plans receive the same allowance each month; unused actions expire at the end of each month.
An action is one thing the Service does on X for you: one action is one reply, post, follow or unfollow. Publishing a reply or post, attaching an image to a published reply or post, following, and unfollowing each use one action. A reply or post containing a link uses one action like any other. Reads, analytics, AI drafts, inbox refreshes, patterns and trends are included and do not use actions. Open in X, where the Service prepares a reply and you publish it yourself on X, is free and unlimited on every plan. The Queue with the xInsightss Chrome extension, where you prepare replies and direct messages and send each one yourself on X, uses no actions and is included on every active plan, with up to 200 items waiting in the queue and up to 20 direct messages added to it in any 24 hours.
A one-time pack adds 1,000 actions for $29. Pack actions are added to the current month and expire with it. Actions cannot be transferred or exchanged for money.
There is no free plan. The Pro trial lasts seven days, requires a card at checkout, includes 300 actions and is available once per X account. When the trial ends, we charge the card $49 for a monthly Pro subscription unless you cancel before the end of the trial.
A monthly plan upgrade takes effect immediately. We charge the full price of the new plan, start a new monthly period, and carry the unused actions from the old plan into it. A monthly plan downgrade takes effect at renewal. Changes to an annual plan take effect at the annual renewal.
Payments are processed by Dodo Payments as merchant of record. Your subscription renews automatically each month or year, according to the interval you chose, until you cancel it. If a monthly renewal payment fails, your remaining actions stay usable for three days so you can update your payment method.
6. Cancellation and refunds
You can cancel at any time from Billing → Cancel subscription in the app, and undo it from Billing → Resume subscription before the period ends. Cancelling stops future charges; your plan and remaining actions stay available until the end of the period you paid for. If you paid annually, you continue to receive all 12 monthly allowances in that paid year. The Dodo Payments customer portal covers your payment method and invoices. Refunds are governed by our Refund and Cancellation Policy, which forms part of these Terms.
7. Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated by reference into these Terms. You keep all rights to the posts and replies you publish; you grant us the right to store and process your X data only as needed to provide the Service to you.
Saved comment analysis is optional, off by default and covered by a separate in-app choice. Turning it off stops future admissions of saved comments to TypeSafe; a request already admitted may finish, and its once-only attempt status and any valid result remain part of your saved workspace data so it is not sent again.
AI reply suggestions are requested separately, one click at a time, and are not enabled by the background analysis setting. Review suggestions for accuracy and suitability before sending; generated text may be wrong.
Studio sends your message and session notes, excerpts of your own saved posts and of posts from your viral library, the conversation and your attachments to its AI processors only when you send a message or ask for drafts, as described in the Privacy Policy. Studio answers and drafts may be wrong; review them before you publish anything.
8. Intellectual property
All intellectual property rights in the Service, including software, design, text, images and trademarks, are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.
9. Termination
You can stop using the Service at any time and ask us to delete your account by writing to the address below. We may suspend or terminate your access if you breach these Terms, if X requires it, or if we discontinue the Service; in the last case you receive a pro-rata refund for the unused part of the current period.
10. Warranties and liability
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure or error-free. The Service depends on the X API, which X may change, limit or suspend at any time; if an action fails because of X, the actions reserved for it are returned unless X has already performed the action.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or any loss of profits, data or goodwill, arising from your use of or inability to use the Service, and our total liability to you is limited to the amount you paid us in the three months before the claim. Nothing in these Terms limits liability that cannot be limited by law, and your statutory consumer rights are not affected.
11. Changes to the Terms
We may revise these Terms from time to time. If we make material changes, we will notify you in the Service or by email at least 14 days before they take effect. By continuing to use the Service after that date, you agree to the revised Terms.
12. Governing law
These Terms are governed by the laws of Poland, without regard to its conflict of law principles and without prejudice to mandatory consumer protection rules of your country of residence.
